Service Approval Agreement
Approvals
I agree to the terms and conditions of this Service Approval Agreement, and hereby approve Mad PC to proceed with the service I have requested.
Damaged or Lost Files. You are responsible for backing up any information contained on your computer or storage device that Mad PC may service for you, and for having a way of restoring such data. Mad PC is not responsible for any damaged or lost PC files, programs, or data even if it occurs during the course of our service for you. Mad PC cannot guarantee confidentiality or non-disclosure. Before our service begins, Mad PC recommends that you remove any data that you consider to be confidential or proprietary from the items we service for you. Mad PC is not responsible for any damaged or lost PC files, or programs due to causes including, but not limited to, natural disaster; acts causing physical damage; power or equipment failure; or viruses, spyware or other forms of intrusion.
Approval to Perform Service. By clicking "I agree", you approve and give permission to Mad PC to perform diagnostic, assembly, repair and/or installation work on the items described on the check-in form.
Warranty Work. It is your responsibility to let Mad PC know of any warranty that may cover the service. Confirmation of the warranty is required before Mad PC begins service. If the service is covered by an existing warranty, you approve Mad PC to perform the service according to the terms and conditions of the warranty, and you agree to pay any costs associated with invoking that warranty. This Service Approval Agreement does not change any of the terms or conditions of any applicable warranty.
Out of Warranty Work. If the service is not covered by an existing warranty, you are approving Mad PC to perform the service, and you are agreeing to pay for the service as described in this Service Approval Agreement. Prices are subject to change without notice. Taxes, shipping & handling, and any other applicable fees are added to your cost. You are responsible for diagnostic costs if you do not approve service.
Terms & Conditions
Compensation. You agree to pay for the service performed at its completion, unless both you and Mad PC have signed a written payment arrangement which supersedes this Service Approval Agreement. Any amount owed that you fail to pay when due is subject to interest at a rate of the lesser of 1½% or the maximum allowed by law. Should Mad PC hire an attorney, or incur any other expense, to collect amounts you owe, you agree to reimburse Mad PC for all of those costs.
Abandonment & Possession. Subject to the limitations of applicable law, and in addition to other remedies that may be available to Mad PC, you approve Mad PC to retain possession of the items we service until you pay all amounts you owe to Mad PC. If you fail to pick up any of the items we service for you within 30 days after receiving notice from us, you are agreeing that you have abandoned the items, and have surrendered them to Mad PC. Also, you are agreeing that Mad PC may dispose of the surrendered items in any manner we choose – including, but not limited to, selling the items – without any liability or compensation to you.
Approval. This Service Approval Agreement represents the understanding between you and Mad PC, and supersedes any prior oral or written agreements.
Non-assignment. You may not assign your rights or obligations under this agreement to any other party without written consent from Mad PC.
Governance & Severability. You and Mad PC agree that this agreement is subject to the laws, rules and regulations of the state of Wisconsin. Should any provisions of this agreement be deemed invalid, all other provisions will remain in effect.
Limits to Warranties. Mad PC warrants its workmanship for 90 days from the time we complete our service for you, unless both you and Mad PC have signed a written service contract which supersedes this Service Approval Agreement. You agree that Mad PC may deny this warranty if your account is not paid in full, or otherwise in good standing. Mad PC cannot warranty software or hardware. To preserve your rights under any warranty extended by a software or hardware manufacturer, Mad PC recommends you to keep all of the documentation and packaging of any software or hardware you may possess.
Limits to Responsibility. Mad PC is not responsibility for any direct or indirect loss or damages you may suffer, including, but not limited to, loss of data, cost of down time, cost of your time, loss of revenue, loss of use, cost of capital, cost of replacement, claims by third parties, or damage to property.
